Privacy Policy

This Data Protection Notice (“Notice”) sets out the basis which Asia Trade Exposition Sdn Bhd (“we”, “us”, or “our”) and our related corporations and affiliates may collect, use, disclose or otherwise process personal data of our customers in accordance with the Personal Data Protection Act (“PDPA”). This Notice applies to personal data in our possession or under our control, including personal data in the possession of organisations which we have engaged to collect, use, disclose or process personal data for our purposes. 1. Personal Data

1.1 As used in this Notice: “personal data” means data, whether true or not, about a customer who can be identified: (a) from that data; or (b) from that data and other information to which we have or are likely to have access.

1.2 Depending on the nature of your interaction with us, some examples of personal data which we may collect from you include name, residential address, email address, telephone number, nationality, gender, date of birth, marital status, photograph, employment information and financial information.

1.3 Other terms used in this Notice shall have the meanings given to them in the PDPA (where the context so permits).

1.4 We generally do not collect your personal data unless (a) it is provided to us voluntarily by you directly or via a third party who has been duly authorised by you to disclose your personal data to us (your “authorised representative”) after (i) you (or your authorised representative) have been notified of the purposes for which the data is collected, and (ii) you (or your authorised representative) have provided written consent to the collection and usage of your personal data for those purposes, or (b) collection and use of personal data without consent is permitted or required by the PDPA or other laws. We shall seek your consent before collecting any additional personal data and before using your personal data for a purpose which has not been notified to you (except where permitted or authorised by law).

2. Collection, Use And Disclosure Of Personal Data

2.1 This section explains what personal information we collect. This section describes what personal information we may collect from you when you use our products and services, and what other personal information we may receive from other sources.

2.2 In this Privacy Policy, personal information refers to the types of personal information that may be collected and used, including:

  • Contact details such as name, email address, postal address and telephone number;
  • Educational, nationality and professional information;
  • Demographic information such as gender and birth date;
  • Payment information, order and purchase history;
  • Comments, feedback, ratings, posts and other content submitted, including survey information;
  • Interests and communication preferences including marketing permissions where appropriate;
  • Location information;
  • Images, including photographs and video footage, for example via CCTV or cameras in our mobile apps, or where we require a photograph on an event badge for security purposes, including biometric data for identification or crime prevention purposes;
  • Information verifying your identity such as passport details to comply with legal obligations in certain countries and to provide visa invitation letters where requested;
  • IP address, website and communication usage information, such as correspondence and details of your use of our website and services obtained through cookies or other tracking technologies; and
  • Name of hotel when attending one of our events.

2.3 This personal information relates to the following categories of people:

  • Prospects, customer contacts, subscribers and users in respect of our services and products;
  • Visitors, sponsors, exhibitors; strategic partners and speakers at our events;
  • Professionals featured in digital and print products, such as senior executive details made available through intelligence products, research, publications;
  • Authors, editors, and reviewers in respect of our publications; and
  • Contacts of our service providers and business partners.

2.4 We may collect this information directly from you when you register for an event or engage with our services and/or platforms. We may also collect this information from third party partners and public sources to the extent permitted by applicable data protection law. In some cases, the data we collect from third parties is provided in a de-identified form and we are only able to connect it to you, if, and when you enter your email address on one of the Asia Trade Exposition Sdn Bhd sites.

(a) Sensitive personal information
If collecting or storing your sensitive personal information, such as information relating to health, disability status or religious beliefs, in order to facilitate your attendance at one of our events, we will typically ask for your explicit consent. However, there are some limited situations where this will not occur, such as if you have a serious accident. If this does occur, we will ensure your privacy rights are protected. In certain limited circumstances, we may collect biometric data for identification. In such cases, we will ask for your explicit consent before the processing takes place.

(b) Data collected by third parties at our events
In some cases, third parties attending our events may collect information about you, for example by taking a photograph of your business card on one of our event mobile apps, or by scanning your visitor badge. We are not the data controller of this data, cannot access the data and are not responsible for third party use. For further information, please see any relevant third party privacy policies or the applicable terms of use for the relevant app.

(c) Aggregated or anonymised personal information
We may create anonymous or aggregated data from personal information we receive about you and other individuals.. Anonymous data might include statistical data or analytics information and we may share this with third party customers.

In certain instances, your employer or another organization may provide you with access to our services. In those cases, your employer will only receive aggregate information, and not personal information about your engagement with our services. For example, we may share that a majority of employees registered with us have fulfilled a certain certification course; however, we will not provide employers with information about which of their employees fulfilled a particular course or which employees are open to recruitment opportunities. We do, however, reserve the right to alert your employer or other organization to your having been banned from our services. These instances will occur only following a breach of our Terms of Service or community standards (i.e., egregious harassment of another member, repeated instances of fraud, etc.).

(d) Children’s personal information
Most of our services and products are directed at business professionals and are not intended for children under the age of sixteen. For the majority of our events and services, we do not knowingly collect personal information from users in this age group and reserve the right to delete such information if we become aware of having collected it. For a small number of our events, we may collect data of children aged 13 to 17. We do not collect the personal data relating to children under the age of 13. If a child , below the age of 13 attends one of our events, the data collected will relate to the parent only.

2.5 We may disclose your personal data:

(a) where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods and services requested by you; or

(b) to third party service providers, agents and other organisations we have engaged to perform any of the functions with reference to the above mentioned purposes.

2.6 The purposes listed in the above clauses may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under a contract with you).

3. How We Use Your Personal Information

We may collect and use your personal data for any or all of the following purposes:

3.1 Product Inquiries & Sales:

  • Respond to inquiries and fulfill pre-contract requests.
  • Process purchases, payments, and debt recovery.

3.2 Call Monitoring:

  • Record calls for training and quality assurance.

3.3 Professional Information:

  • Incorporate publicly available professional data into products.
  • Verify professional status.
  • Use data from consulting service engagements.

3.4 Event & Exhibition Management:

  • Manage event logistics, payments, and analytics.
  • Maintain speaker/sponsor databases.
  • Share data with exhibitors (with consent).
  • Use event photos/videos for promotion (with consent, and lawful basis).
  • Utilize badge scanning for access control and traffic analysis.
  • Use smart tags to monitor attendance.
  • Manage virtual events/exhibitions and analyze visitor interactions.
  • Share data with virtual booth sponsors and exhibitors.
  • Utilize event app data for navigation, recommendations, and analytics.
  • Gamification features collect user behavior data for scoring and ranking.

3.5 Publishing Services:

  • Disseminate and promote published work.
  • Fulfill contractual obligations.
  • Use event photos/videos for author promotion.

3.6 Marketing:

  • Send newsletters and marketing emails (with consent or legitimate interest).
  • Send SMS/text messages or make marketing calls (where lawful).
  • Send postal mailings.
  • Share data with co-branded partners (with notice and opt-out).
  • Client facing marketing services: create profiles, and marketing segments.
  • Social media advertising.

3.7 Surveys:

  • Conduct research surveys.
3.8 Customer & Prospect Management:
  • Analyze customer preferences and improve products.
  • Mobile app and website analytics.
  • Email marketing analytics.

3.9 Online Communities:

  • Facilitate online membership communities.
  • Customer Chat areas for product recommendation.

3.10 Enquiries & Complaints:

  • Respond to inquiries and resolve complaints.
3.11 News Alerts:
  • Provide news alerts and analyze email open rates.

3.12 Automated Decision-Making:

  • Personalize web content and conduct general profiling.
  • Used in publishing for sample requests.
  • Never used for legally significant decisions.
3.13 Legal Obligations:
  • Prevent fraud and comply with regulations.
  • Screen against sanctions lists.
  • Collect data for event licenses and law enforcement requests.

4. Deemed Consent By Notification

4.1 We may collect or use your personal data, or disclose existing personal data for secondary purposes that differ from the primary purpose which it had originally collected for pursuant to clauses 5 and 6. If Asia Trade Exposition Sdn Bhd intends to rely on deemed consent by notification for such secondary purposes, Asia Trade Exposition Sdn Bhd will notify you of the proposed collection, use or disclosure of his personal data through appropriate mode(s) of communication.
4.2 Before relying on deemed consent by notification, Asia Trade Exposition Sdn Bhd will assess and determine that the collection, use and disclosure of the personal data will not likely have an adverse effect on you.

4.3 You will be given a reasonable period to inform us if you wish to opt-out of the collection, use and disclosure of your personal data for such purposes.

4.4 After the lapse of the opt-out period, you may notify us that you no longer wish to consent to the purposes for which your consent was deemed by notification by withdrawing your consent for the collection, use or disclosure of your personal data in relation to those purposes.

5. Reliance On The Legitimate Interests Exception

5.1 In compliance with the PDPA, we may collect, use or disclose your personal data without your consent for the legitimate interests of Asia Trade Exposition Sdn Bhd or another person. In relying on the legitimate interests exception of the PDPA, Asia Trade Exposition Sdn Bhd will assess the likely adverse effects on the individual and determine that the legitimate interests outweigh any adverse effect.

5.2 In line with the legitimate interests’ exception, we will collect, use or disclose your personal data for the following purposes:

(a) Fraud detection and prevention;

(b) Detection and prevention of misuse of services;

(c) Network analysis to prevent fraud and financial crime, and perform credit analysis; and

(d) Collection and use of personal data on company-issued devices to prevent data loss.

The purposes listed in the above clause may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter.

6. Withdrawing Your Consent

6.1 The consent that you provide for the collection, use and disclosure of your personal data will remain valid until such time it is being withdrawn by you in writing. You may withdraw consent and request us to stop collecting, using and/or disclosing your personal data for any or all of the purposes listed above by submitting your request in writing or via email to our Data Protection Officer at the contact details provided below.

6.2 Upon receipt of your written request to withdraw your consent, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we shall seek to process your request within thirty (30) business days of receiving it.

6.3 Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such circumstances, notify you before completing the processing of your request. Should you decide to cancel your withdrawal of consent, please inform us in writing in the manner described in clause 8 above.

6.4 Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclosure without consent is permitted or required under applicable laws.

7. Access To And Correction Of Personal Data

7.1 If you wish to make (a) an access request for access to a copy of the personal data which we hold about you or information about the ways in which we use or disclose your personal data, or (b) a correction request to correct or update any of your personal data which we hold about you, you may submit your request in writing or via email to our Data Protection Officer at the contact details provided below.

7.2 Please note that a reasonable fee may be charged for an access request. If so, we will inform you of the fee before processing your request.

7.3 We will respond to your request as soon as reasonably possible. In general, our response will be within thirty (30) business days. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any personal data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the PDPA).

8. Protection Of Personal Data

8.1 To safeguard your personal data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures such as minimised collection of personal data, authentication and access controls (such as good password practices, need-to-basis for data disclosure, etc.), encryption of data, data anonymisation, up-to-date antivirus protection, regular patching of operating system and other software, securely erase storage media in devices before disposal, web security measures against risks, usage of one time password(otp)/2 factor authentication (2fa)/multi-factor authentication (mfa) to secure access, and security review and testing performed regularly.

8.2 You should be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

9. Accuracy Of Personal Data

We generally rely on personal data provided by you (or your authorised representative). In order to ensure that your personal data is current, complete and accurate, please update us if there are changes to your personal data by informing our Data Protection Officer in writing or via email at the contact details provided below.

10. Retention Of Personal Data

10.1 We may retain your personal data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws.

10.2 We will cease to retain your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal data was collected, and is no longer necessary for legal or business purposes.

11. Transfers Of Personal Data Outside Of Malaysia

We generally do not transfer your personal data to countries outside of Malaysia. However, if we do so, we will obtain your consent for the transfer to be made and we will take steps to ensure that your personal data continues to receive a standard of protection that is at least comparable to that provided under the PDPA.

13. Effect Of Notice And Changes To Notice

13.1 This Notice applies in conjunction with any other notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your personal data by us.

13.2 We may revise this Notice from time to time without any prior notice. You may determine if any such revision has taken place by referring to the date on which this Notice was last updated. Your continued use of our services constitutes your acknowledgement and acceptance of such changes. 

14. Changes to this Privacy Policy

Please note that we update our Privacy Policy from time-to-time. To keep up with changing legislation, best practice and changes in how we process personal information, we may revise this Privacy Policy at any time. Depending on the nature of the changes, we may update you via email if we have your personal information; or we may update the Policy without notice by posting a revised version on this website.
